A dry or passive trust of land is executed by force of the statute of uses, 27 Hen. VIII, c. 10, which has become part of the common law of this state. A trust of personalty is likewise executed where the settlor or testator has imposed no duties upon the trustee or clothed him with discretionary power or required him to take any action to effectuate any object of the trust and the cestui que trust has the legal title without recourse to equity by a bill to compel a conveyance.
