The appellant was charged with the offense of burglary as defined by Â§ 10-701, Burns 1942 Replacement (Acts of 1929, ch. 54, Â§ 2, p. 136; 1935, ch. 212, Â§ 1, p. 1017; 1941, ch. 148, Â§ 4, p. 447).[Footnote 1] After trial by jury and verdict of guilty, the judgment of conviction sentenced him to imprisonment in the state prison for a term not less than ten years nor more than twenty years, and disfranchised him for a period of ten years. His motion for a new trial, which assigned as causes therefore, (1) "That the verdict of the jury is contrary to law," and, (2) "That the verdict of the jury is not sustained by sufficient evidence," was overruled, and this is the error assigned upon appeal.
